ABSTRACT

The thesis examines certain legal aspects of road transport cooperatives. As cooperatives exhibiting characteristics inherent to this type of entity, they are subject to the applicable national and regional regulations on cooperatives. As entities engaging in transport or transport-related operations, they are also subject to the regulations governing land transport and contracts for the carriage of goods by land. Both perspectives give rise to questions on different aspects of these cooperatives in their different forms. This includes the problem resulting from the application of regional regulations on cooperatives and the national legislation on transport, the conditions to be met for carrying out transport activities, the contracting of transport in one’s own name and the assumption of the status of carrier, the internal legal relationships and the typical cooperative activity carried out between the entity and its members, operations with non-member third parties, and the personal and administrative legal liability of the corporate entity and its members.
